These Terms of Service ("Terms") govern your access to and use of Sable, operated by Valar Development Group ("Company," "we," "our," or "us"). Sable is available at sable.salon and through our mobile applications.
Please read these Terms carefully. By accessing or using Sable, you agree to be bound by them. If you do not agree, do not use the service.
1. Acceptance of Terms
By creating an account, accessing, or using Sable in any way, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to be bound by them and our Privacy Policy, which is incorporated by reference.
If you are using Sable on behalf of a business (salon, studio, or other organization), you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
Sable is a SaaS platform that provides booking, scheduling, client management, payment processing, and business intelligence tools for independent hair stylists and salon businesses. Features vary by subscription plan. We reserve the right to modify, suspend, or discontinue any feature or the service as a whole, with reasonable notice where practicable.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete registration information
- Promptly update your information if it changes
- Notify us immediately of any unauthorized account access at support@sable.salon
- Not share your login credentials with anyone
- Not create accounts using false identities or for the purpose of abuse
We are not liable for losses resulting from unauthorized use of your account where you failed to take reasonable precautions.
4. SMS Communications
Sable operates an SMS messaging program under the program name Sable. By providing your phone number and using the platform, you may receive the following types of SMS messages:
- Authentication: One-time passcodes for account sign-in and verification.
- Transactional: Appointment confirmations, reminders, and booking updates.
- Marketing: Promotional messages about Sable features and offers, sent only with your express prior consent.
Message Frequency: Message frequency varies based on your account activity and preferences. Authentication messages are sent on demand. Appointment reminders depend on your schedule. Marketing messages are infrequent.
Msg & Data Rates May Apply. Standard message and data rates from your mobile carrier may apply to SMS messages you send and receive.
To Opt Out: Reply STOP to any SMS message to unsubscribe from that message category. You will receive a final confirmation message and no further messages of that type (authentication codes required for account access are exempt).
For Help: Reply HELP to any SMS message or email us at support@sable.salon.
Carriers are not liable for delayed or undelivered messages. Sable is not responsible for charges incurred from your carrier related to SMS messages.
5. Payment Terms
Sable is offered on a subscription basis. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis at the then-current subscription rate.
- All fees are in USD and are non-refundable except as required by law or as otherwise stated in our refund policy.
- Subscription plans renew automatically unless cancelled before the renewal date.
- We reserve the right to change pricing with 30 days' advance notice. Continued use after a price change constitutes acceptance of the new rate.
- Payment processing is handled by Stripe. By using Sable, you also agree to Stripe's Terms of Service.
- Sable facilitates payments between clients and stylists/salons. We are not a party to those transactions and are not liable for disputes between clients and service providers.
6. Intellectual Property
All rights, title, and interest in Sable — including the software, design, trademarks, logos, and content created by Valar Development Group — remain our exclusive property. These Terms do not grant you any ownership rights in Sable.
You retain ownership of all data, content, and client records you input into the platform. You grant us a limited license to process and store that data solely for the purpose of providing the service to you.
You agree not to copy, modify, reverse engineer, decompile, or create derivative works based on Sable without our prior written consent.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Valar Development Group and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of Sable, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
Sable is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Termination
You may terminate your account at any time from your account settings or by contacting us at support@sable.salon. Termination takes effect at the end of the current billing period.
We may suspend or terminate your access to Sable at any time, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or if required by law. Upon termination, your right to use the service ceases immediately.
Sections 6 (Intellectual Property), 7 (Limitation of Liability), 9 (Governing Law), and any accrued payment obligations survive termination.
9. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration conducted in accordance with the American Arbitration Association rules, unless you are located in a jurisdiction where arbitration clauses are unenforceable. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
10. Changes to Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice via email or an in-app notification at least 14 days before the changes take effect. Your continued use of Sable after the effective date constitutes acceptance of the revised Terms.
